Frequently Asked Questions

What are the fees?

Helpfully, you will not pay any fees or interest out-of-pocket until you reach your settlement. Any applicable fees and charges are debited to your account and repaid as a lump sum at settlement of your family law property matter.

Once approved, your line of credit is subject to the following:

Interest: Interest is calculated on the outstanding balance of your account. This means that interest is charged only on what you actually use from the date of each drawdown. You do not pay interest on the unused credit on your account. For new lines of credit the interest rate starts from 9.6% per annum for clients of PartnerPlus law firms.

Assessment and Administration Fee: This covers the costs of conducting a full merits assessment of your application based on your unique circumstances. It depends on the complexity of your matter and size of your line of credit, and starts from $560.

Invoice Processing Fee: This covers the cost of processing invoice payments on your behalf and reviewing updates on the status of your legal matter. The Invoice Processing Fee is 3.75% of each amount drawn on your account.

A security registration (or caveat) fee may also apply depending on your circumstances. A detailed breakdown of fees and charges is provided to all applicants.

How is JustFund different?

Our approach to family law finance looks beyond traditional measures such as income, employment and credit history. We consider your circumstances, legal matter and expected entitlement, with a team that understands the financial and personal pressures separation can create.

What expenses can I use a JustFund line of credit for?

JustFund can provide funding for family law legal fees, including approved solicitor, counsel, court and expert costs. In some circumstances, funding for divorce and separation-related expenses may also cover temporary accommodation, school fees, counselling and other approved costs. Payments are made after you approve the relevant invoice.

How does repayment work?

We fund on the basis that repayment occurs when your property settlement is finalised, and only from the proceeds you receive. You can repay early and there is no early repayment fee.

Is it necessary to provide security?

JustFund is different from most lenders in the separation space because taking security isn’t always a requirement. Security requirements are assessed on a case-by-case basis, meaning funding can still be provided if you’re not on property title. In certain instances, it may be necessary to place a caveat on property where you are registered on the title, and additional fees (payable only when you settle your matter) may apply in circumstances where security is taken.

Is there a minimum and maximum funding amount?

$5,000 minimum. No maximum.

When can I apply?

You can apply for family law funding at different stages of separation, including when you first engage a lawyer or after legal costs have started to build. Our team can explain what information is needed and help you understand your options.

How do you assess eligibility?

Applications for family law funding in Australia are assessed based on your individual circumstances, legal matter and expected entitlement under the Family Law Act. We consider whether the funding requested is appropriate for your situation rather than relying only on income or credit history.

How do I apply?

You can apply for family law funding directly, or your lawyer can apply on your behalf.

Does applying affect my credit score?

JustFund performs a “soft” credit check, which does not impact your credit score. The soft check will be noted on your credit report, recording that a soft credit check was requested.

Do I need a solicitor to apply?

You are welcome to apply to understand if you might be eligible for funding. However, a line of credit can only be established once you have selected a lawyer to act for you on your family law matter. If you don’t have a lawyer, JustFund can help you find one from our large, national network of family law firm partners.

What if my chosen law firm isn't a JustFund partner?

We will support your choice of law firm, and will work with them to explain and meet our funding requirements.

How can my law firm become a JustFund partner?

They should visit our For Lawyers page.

How do you pay law firm invoices?

JustFund pays invoices that are submitted by the law firm and approved by the client.

Do you fund both parties in a family law matter?

Yes, we can consider funding on both sides. To prevent any conflict of interest, if one party is already a client of JustFund, the other party can be funded via our sister company, LegalAccess Fund. LegalAccess Fund operates with its own dedicated team and independent systems, ensuring that each client’s information, application and funding are kept strictly separate and confidential.
